Prove the Connection or Show the Name Points Elsewhere: Clearing a Section 2(a) Refusal Over a School, Agency, Tribe or Company Name

A Section 2(a) refusal says your mark falsely suggests a connection with a university, government agency, tribe, company or famous estate. Permission from the institution, the heirs' rights, another meaning, or goods its fame does not reach: the real USPTO files for each.

You are in this situation if your Office action says your mark "may falsely suggest a connection with" a university or its team, a government agency or program, a tribe, a company, or a famous person who has died, sets out a four-part test, and asks you to "specify whether the person or institution named in the mark has any connection with applicant's goods".

Before you argue

Three usual exits are closed. Section 2(a) bars a false connection "on either the Principal or the Supplemental Register" (TMEP 1203.03), and a claim of acquired distinctiveness does not answer it (TMEP 1212.02(a)). Nor does a disclaimer: "Disclaiming the name of, or acronym for, the U.S. government agency or instrumentality to which the mark refers generally will not overcome the §2(a) refusal" (TMEP 1203.03(b)(ii)). WHERE RED RAIDERS BANK.'s record carried a RED RAIDERS disclaimer; the next letter refused the mark and added that "a disclaimer of this matter is not required."

The dead are covered too: Section 2(a) protects "persons, living or dead" (TMEP 1203.03(a)(i)), while Section 2(c), the separate consent rule for names, generally does not apply to the dead (TMEP 1206). For one more false-connection refusal, issued to a private applicant, see our BOARD OF PEACE file history.

If you decide to answer: four routes that cleared the name

The examiner has to show four things (TMEP 1203.03(b)(i)): that the mark is "the same as, or a close approximation of, the name or identity previously used by another person or institution"; that it "points uniquely and unmistakably to that person or institution"; that the institution "is not connected with the activities performed by the applicant under the mark"; and that its "fame or reputation ... is such that, when the mark is used with the applicant’s goods or services, a connection with the person or institution would be presumed." Each route below goes after one of them.

ArgumentThe rule it usesWhat to fileApprovedRefused
1. The institution is connected: its own permissionThird element: a real endorsement or sponsorship (TMEP 1203.03(b)(i))Permission or consent from the office that controls the name; proof the institution sells your goodsWHERE RED RAIDERS BANK., LITTLE SHELL KWE, CHEROKEE COPPERNAVY SEABEE FOUNDATION
2. The rights passed to you: heirs and successorsA dead person's name is protected only while heirs or successors can assert it (TMEP 1203.03(a)(i))The successor-in-interest record, the heirs' ownership or license, an assignment to the rights holderGEORGE CARLIN, LUGOSI, KHO LIANG IEJULIA CHILD (first round)
3. The word means something else on your goodsSecond element: does the mark point uniquely to the institution? (TMEP 1203.03(b)(i))Dictionary entries, company history, evidence of the other meaning in useSEAL TEAM (sealants), MDP MARINE DEFENSE PACKAGINGSEAL TEAM (insulation), GSA GURU
4. The institution's fame does not reach your goodsFourth element, judged against the goods (TMEP 1203.03(b)(i) and (b)(ii))Evidence of what the institution does and does not sell; facts about your buyersCHEROKEE ACQUISITION, TRICARE, TELEMUNDO REALTYUFFIZI (clothing stores)

Whichever you choose, attach the documents you rely on (the permission email, the state filing, registration printouts); a list typed into the response does not count as evidence.

1. The institution is connected: permission from the body that controls the name (the third element)

The rule: "A connection with an entity is established when the record establishes a specific endorsement, sponsorship, or the like of the particular goods and services, whether written or implied" (TMEP 1203.03(b)(i)). For government names, the manual adds: "This authorization to use, by itself, should not be construed to extend to authorization to register marks that include matter the applicant does not own" (TMEP 1203.03(b)(ii)).

When it fits: the institution has licensed you, sponsors you or sells your goods, and someone with authority over its name will say so in writing.

What to file: the permission itself, from the office that controls the name (a licensing office, a tribal government), or proof that the institution sells your goods. Serving its community, or the support of its former members, did not stand in for it.

Mark and ownerGoods or servicesWhat the response didResult
WHERE RED RAIDERS BANK. by Texas Tech Federal Credit UnionBanking servicesIts first answer called itself "an independent, member-owned financial institution" serving Texas Tech, and drew the refusal. Its second response filed an email granting permission from the university official responsible for trademark licensingApproved 29 days after the second response; registered March 3, 2026. Read the Office action, first response, next letter and second response.
LITTLE SHELL KWE by MISKOMIN, LLCMarketing consultingRefused for the Little Shell Tribe of Chippewa Indians of Montana; filed a two-page document whose file name calls it the tribe's authorization and consent letterApproved the day after the response; registered January 6, 2026 (later assigned to its current owner). Read the Office action and response.
CHEROKEE COPPER by Cherokee Copper LLCCopper jewelry made by Native Americans, and stores selling itShowed that the Cherokee Nation sells its pieces in its online shop and gift shops (a shop page attached) and that its owner is a Nation citizen; also limited the goods to Native American work, disclaimed COPPER and answered a likelihood-of-confusion refusal. The record does not show which move carried itApproved in March 2025 with an examiner's amendment; registered May 20, 2025. Read the Office action and response.
NAVY SEABEE FOUNDATION by Navy Seabee FoundationCharitable fundraising and scholarships for Seabees and their familiesFiled a memorandum of agreement (the examiner called it an MOU from the Naval History and Heritage Command), then a joint declaration of two retired rear admiralsRefused: final refusal June 29, 2026; a request for reconsideration was denied; still pending (second final refusal issued August 27, 2026). Read the Office action, first response, last response and final refusal.

In their words. The letter that answered WHERE RED RAIDERS BANK.'s first response: "The Texas Tech University and their athletic team are not connected with the activities performed by the applicant as the applicant asserted that they are an independent financial institution." LITTLE SHELL KWE's examiner, on who can give it: "the rights to the tribal name reside with the tribe itself, and not with individual members of the tribe." NAVY SEABEE FOUNDATION's: "There is no information provided directly from the Department of the Navy clarifying the nature of the relationship between the Navy Seabee Foundation and the Department of the Navy."

The pattern: the approved files showed the institution's own yes: its licensing office, its tribal letter, its shop. The refused file showed ties through a Navy command and retired officers, and each letter asked for word from the Department of the Navy itself.

2. The rights passed to you: heirs, successors and their licensees (who holds the name now)

The rule: for a person who has died, the "right to the use of a designation which points uniquely to his or her persona may not be protected under Section 2(a) after his or her death unless heirs or other successors are entitled to assert that right" (TMEP 1203.03(a)(i)). The manual's test is "whether or not there is someone (this may be a natural person, estate, or juristic entity) with rights in the name."

When it fits: you are the estate, the heirs' company or their licensee, or the rights holder will take over the application.

What to file: the state record naming you or your owner as successor, or a plain statement of who inherited the rights and what they granted you. Consent to use is not consent to register.

GEORGE CARLIN by Main Sequence, Ltd.Comedy DVDs and comedy showsFiled the California Secretary of State's record of its owner's claim as successor-in-interest to Carlin's name under his willApproved: the next letter called the refusal "obviated"; after a separate performer-name refusal, registered September 15, 2026. Read the Office action, response and next letter.
LUGOSI by Lugosi LLCToy figures, bobblehead dolls and puzzlesStated, with no exhibits, that the actor's estate passed to his son, who owns the applicant, and that the family's post-mortem publicity right is registered with the California Secretary of StateApproved 29 days after the response; registered November 18, 2025. Read the Office action and response.
KHO LIANG IE by Koninklijke Mosa B.V.Ceramic floor and wall tilesStated, with no exhibits, that a 2003 agreement with the Dutch designer's heirs lets it use his name for a tile collection he designed with the companyApproved 16 days after the response, with an examiner's amendment to the filing basis; registered October 27, 2026. Read the Office action and response.
JULIA CHILD by The Trustees of Julia Child Foundation for Gastronomy and the Culinary ArtsLive rose plantsFirst response filed Julia Child's 2004 letter agreeing to have a rose named for herRefused at first: final refusal July 27, 2025. It was then assigned to the foundation's trustees, who asked for reconsideration; the refusal was withdrawn (the record does not show which move cleared it), and it registered December 23, 2025. Read the Office action, first response, final refusal and next letter.

In their words. LUGOSI's examiner, naming what was missing: "The record does not provide any indication that the estate of Bela Lugosi, or individuals with control over the name/likeness have any connection with the goods sold under the mark." JULIA CHILD's final refusal: "The document submitted was not a consent to register her name as a trademark with the United States Patent and Trademark Office".

The pattern: every approved file put the people who hold the name behind the application, as owner or licensor; two did it with a statement alone. The 2004 letter agreed to a rose's name, not to a registration; the refusal was withdrawn only after the foundation that holds the name took over the application.

3. The word means something else on your goods (the second element)

The rule: "the question is whether, as used with the goods or services in question, ... consumers would view the mark as pointing uniquely to the person or institution, or whether they would perceive it to have a different meaning" (TMEP 1203.03(b)(i)). The limit, from the same section: "unassociated third-party use of a term does not in and of itself establish" that a name points elsewhere.

When it fits: the word in your mark has an ordinary meaning (seal, marine) that your goods or your history bring forward.

What to file: dictionary entries for the other meaning and a declaration on where your name came from.

Mark and ownerGoods or servicesWhat the response didResult
SEAL TEAM by Star Group Solutions Inc.Silicone and acrylic sealants for constructionArgued that on sealants "seal" reads as to fasten or coat, making the mark a pun rather than a claim to the Navy's SEAL Teams, and that the Board's NATO decisions turned on the goodsApproved: the next letter withdrew the refusal and required a SEAL disclaimer, which it entered; published for opposition on October 6, 2026. Read the Office action, response and next letter.
MDP MARINE DEFENSE PACKAGING MUNITIONS PACKAGING, TRANSIT & STORAGE SOLUTIONS by Marine Lumber International, LLCMetal and plastic boxes, pallets and ammunition casesFiled declarations tracing MARINE to the parent company's 1946 start supplying lumber to the steamship trade, and dictionary entries whose first senses relate to the sea. The same response took an assignment of a registration cited against it and disclaimed the wording; the record does not show which move carried itApproved three days after the response; registered December 3, 2024. Read the Office action and response.
SEAL TEAM by O'Neill's Quality Insulation LLCInstalling and removing insulationMade the same TEAM-versus-TEAMS and "seal" arguments, with the dictionary page and the examiner's Wikipedia page attachedRefused: final refusal March 3, 2026; abandoned. Read the Office action, response and final refusal.
GSA GURU by Avant-Garde Concepts LLCConsulting for federal government contractorsSaid GSA is used in many non-government contexts and filed a typed table of other GSA organizations, with a statement of no affiliationRefused: final refusal (with likelihood-of-confusion and specimen refusals); abandoned. Read the Office action, response, next letter and final refusal.

In their words. The sealant maker: "the double entendre would make the applied-for mark unmistakably point away from the government agency." GSA GURU's examiner, on its table of other GSAs: the applicant "has provided no evidence in support of this information and/or any context as to what applicant is attempting to show with that information."

The pattern: the approved files tied the other meaning to the goods themselves (a sealant seals; a shipping company's name says marine). The two SEAL TEAM files made nearly the same argument; it carried the sealant, not the insulation installer. GSA GURU's other GSAs (a geological society, a student alliance, a telecom group) were far from federal contracting, the field its own services named.

4. The institution's fame does not reach your goods (the fourth element)

The rule: the Federal Circuit, quoted in TMEP 1203.03(b)(i): "a party's name may be associated with particular goods such that a false association may be established with goods or services of that type even if it would not have been established with respect to entirely different goods or services." For agencies, "the identified goods or services must be scrutinized in the context of the current marketplace to determine whether they are of the type to be offered by U.S. government agencies and instrumentalities" (TMEP 1203.03(b)(ii)).

When it fits: the institution is famous for something far from what you sell.

What to file: pages showing what the institution does and does not offer, answering the examiner's evidence; facts about your buyers; other owners' registrations of the word, as support.

Mark and ownerGoods or servicesWhat the response didResult
CHEROKEE ACQUISITION by Cherokee Trading LLCBrokerage of bankruptcy claimsAnswered the examiner's point that the Nation's businesses include finance with the Nation's own page showing its investment arm serves no outside clients; an affidavit on its narrow market; certificates for six CHEROKEE registrations of other ownersApproved about four and a half months after the response; registered September 22, 2026. Read the Office action and response.
TRICARE by Tri-K Industries, Inc.Chemical ingredients for cosmetics, sunscreen and hair careArgued that the Defense Department's TRICARE health program makes no cosmetic ingredients; filed other owners' TRICARE registrations and private registrations of agency acronyms. It also answered a likelihood-of-confusion refusalApproved 35 days after the response; registered June 24, 2025. Read the Office action and response.
TELEMUNDO REALTY by Telemundo Realty Corp.Real estate brokerage and leasingArgued that the TV network's fame lies in broadcasting, not real estate, and that REALTY and a globe design give the mark its own identity; filed only a page on who owns the networkApproved 28 days after the response; published for opposition on September 22, 2026. Read the Office action and response.
UFFIZI by Uffizi Inc.Designer-clothing stores and personal fashion consultingArgued that in a clothing store UFFIZI does not point to the Florence gallery (an earlier UFFIZI registration covered women's shoes) and that the gallery's U.S. publicity came after its own useRefused for the clothing stores, withdrawn for fashion consulting; it did not answer, the stores were deleted, and it registered April 14, 2026 for consulting alone. Read the Office action, response and next letter.

In their words. CHEROKEE ACQUISITION: "The Cherokee Tribes do not operate in the general financial sector." TELEMUNDO REALTY: "The network's recognition in the entertainment field does not translate into a presumption of connection where the relevant goods or services bear no logical relationship to broadcasting or media." The letter that kept UFFIZI's stores refused: "The gallery also provides an online retail store featuring multiple clothing items."

The pattern: the approved files showed where the institution's business stops: the tribe's investment arm serves no outside clients, the agency runs a health program, the network broadcasts. UFFIZI won where the gallery has no business (consulting) and lost where its own shop sells the same thing (clothing).

Arguments that rarely carried a case alone

A statement of no affiliation proves the third element for the examiner: GSA GURU's next letter answered that "this refusal applies specifically because applicant is not affiliated with the U.S. Government or the GSA". CFIUS.AI wrote that it "does not assert an affiliation, sponsorship, or endorsement by the U.S. Government, the Department of the Treasury, or CFIUS," made no other argument, drew a final refusal and was abandoned. Nor does good faith: NMJL's final refusal said "The fact that applicant did not intend to adopt the name of, or trade upon the goodwill of, the named person or institution does not obviate a false connection refusal" (still pending). Other owners' use of the word appeared in winning responses only beside other facts (CHEROKEE ACQUISITION, TRICARE); GSA GURU's list of other GSAs stood alone.

A free-speech challenge has been tried: the Board rejected one, "explaining that the provision is viewpoint neutral" (TMEP 1203.01).
