The mark consists of product packaging resembling a three-dimensional cone shape with an opening at the top and the words ZURU SPARKLE GIRLZ FAIRY PRINCESS printed on the front, as shown in the representation above and other representations attached to the application. The above product packaging holds a doll standing feet first inside the open cone shape with its head and upper torso protruding through the top of the open cone. The mark to be registered is only the colorless (black and white) mark depicted in the corresponding UK series registration that registers the mark in both color and no color. While only a front view representation of the mark is submitted as the mark drawing, which is because that is all the application form permits to be submitted, applicant is also submitting additional drawings of the mark to show rear, left, right and perspective views in order to match the mark drawings in the UK registration substantially identically to satisfy the requirements for a Section 44 filing basis and priority claim. The additional drawings and an image showing how the trade dress is used with the goods is enclosed herewith in the additional information section of the application. Pursuant to TMEP § 1202.02(c)(iv), applicant will file a petition to the Director to permit inclusion of the additional drawings showing additional perspectives of the three-dimensional trade dress mark if necessary.
