The mark consists of a three dimensional mark consisting of the trade dress applied to packaging for candy; namely the configuration of a white, rectangular cardboard box having top and bottom surfaces whose width and length are substantially greater than the height of the box, creating a box where the top and bottom surfaces are the largest surfaces, the side surfaces are the second largest surfaces, and the end surfaces are the smallest surfaces, onto which is printed a design comprising; 1. on the top surface, a wavy ribbon design extending across the top surface of the white box approximately midway and the white box top surface immediately underneath the ribbon design having a transparent window framed on three sides by the remainder of the white box top surface through which the jelly bean product is visible; and 2. one end surface having a band covering the entire end surface.
