"BARILLA" in Class 035, 041, and 042 has become distinctive of the goods/services as evidenced by the ownership on the Principal Register for the same mark for sufficiently similar goods/services of active U.S. Registration Nos. 4239681 and 5930574. These two marks are identical to the pending application and for related goods / services. Applicant believes this is proper under a 2F claim. The mark BARILLA has also been in use sine 1900 and at least 1965 in the United States as evidence from Reg. No. 2005752. Applicant believes this is helpful in its full claim of acquired distinctiveness for the brand. As to the pending application to Class 009, Applicant does not have a related registration to point to as it relates to the BARILLA brand. However, the brand is a well known and established brand in the United States and is expanding its mark to Class 009. While Applicant is not going to denay the fact that the trademark BARILLA is a surname of its founder, it does not believe the surname is common. As a rare surname it is more famous as a product brand then a surname - from the fact that the BARILLA products have been in circulation for over 100 years.
